Policies


FEES & PAYMENTS

• A RETAINER totaling 50% of the total price of services (unless otherwise specified) is required in advance. This initial payment reserves the Photographer’s time, and shall be applied towards the total cost of the services to be rendered.

• Photographer agrees to not advertise availability of this same time slot to any other potential clients. If Client fails to show up for his/her scheduled appointment, Client will forfeit the RETAINER.

• Client is responsible for arranging the location access and any permits/passes related to doing so, as well as any costs/fees associated with the location. These include, but are not limited to, access fees and parking. Photographer will not guarantee or arrange payment on any location.

• Session fee does not cover travel expenses outside a 25 mile radius of downtown Orlando. Any location outside of these limits will be subject to a .54/mile charge, including tolls.

• The BALANCE of the payment for photography services is due at the time of your photo session (unless otherwise specified).

• Client will pay Photographer a returned check fee of $25.00 plus any fees assessed by Photographer’s banking institution as a result of the returned check.

• Photographer accepts cash, checks and VENMO payments. Please make checks payable to Claudia Valcich.


SHOOTS

• All shoots are by appointment only.

• Session times are approximate. A shoot may require more or less time, depending upon the circumstances.

• It is the Client’s responsibility to be on time for his/her session. If the Client is late for the session, Client will have the amount of time late deducted from the time allotted for the session. If shooting on location and Client is more than 15 minutes late, Photographer reserves the right to cancel the session and the RETAINER will be forfeited.

• The Client is responsible for providing any props or outfits that are to be used within the session. Photographer will not be held responsible for additional sessions needed due to forgotten items.

• Hair and makeup services are the responsibility of the Client. Recommendations of hair/makeup artists can be made upon request; however, Claudia Valcich and Claudia Valcich Photography are not responsible for the quality of service.


SAFETY & LIABILITY

• Client has the right to refuse any pose or location area. It is the responsibility of the Client and/or guardians(s) of Client, to refuse to stand or be placed in any position or location where they feel uncomfortable or endangered.

• If Client and/or guardian(s) of Client agree to stand or be placed in any position or location during the session, they assume all risks associated with the position and location. Photographer will not be responsible for any personal injury and/or property damage that might result from Client and/or guardian(s) being injured during a session.


PETS

• When shooting on location at the Client’s home, light stands, tripods and cables are a potential hazard for your pets. We know your pets are an important member of your family; but, we must also ensure a safe working environment for both our team and your pets. Therefore, the Photographer requests any pets be secured in a safe environment until the end of the shoot.

• If Client wishes to include his/her pet(s) in the portrait session, Client must discuss this with Photographer in advance of the photo session. Photographer reserves the right to not work with any animal she deems uncooperative or unsafe.


RESCHEDULING, CANCELLATIONS & RESHOOTS

• Client understands that by entering into this agreement, Photographer is foregoing other photographic jobs. If Client needs to reschedule due to illness or other situation, Client may reschedule their session at least (5) days prior to their session without penalty. The RETAINER will be applied to the new date.

• Should Client fail to give (5) days notice, or decide to completely cancel the shoot, the RETAINER is forfeited and will not be refunded.

• Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or acts of God. In the event of inclement weather, Photographer and Client will make every effort to reschedule the session at the earliest date. The RETAINER will be applied towards the new date.

• Reshoots are determined at the discretion of the Photographer, and will not be offered for poor choices in clothing, make-up, hair, weather related and behavioral issues or events that are beyond the Photographer’s control.

• All effort is made to guarantee your satisfaction with your images at the end of your session. In the unlikely event that the Client is dissatisfied with the final results based solely on personal preference, Photographer may offer a single reshoot at an additional, discounted price; however, Client will receive images from the second session only.

• A reshoot at no cost to the Client may be offered at the Photographer’s discretion if the circumstances are warranted (such as technical difficulties, inclement weather, location problems, etc.)


FAILURE TO PERFORM

• If the Photographer cannot perform this Contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness or emergency, the Photographer and Client shall make every attempt to reschedule the session. If a reschedule is unable to be agreed upon, Photographer shall return the RETAINER to the Client and shall have no further liability.

• This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the the Client’s order.


IMAGE DELIVERY

• Please allow 3-5 business days for delivery of session proofs, and 5-7 business days for delivery of final retouched images.

• Shorter turn-around times may be available, and must be agreed upon in advance.

• All final images will be delivered in a high resolution digital format (suitable for either web or print use). The RAW, unedited images are not an accurate representation of the Photographer’s work and will not be available to the Client.

• All images become the responsibility of the Client once received. Client will not hold Photographer responsible if something should happen to the files upon receipt.

• Photographer does not provide printing services in-house, but prints and other products can be ordered from Bay Photo through the CVP website.

• Photographer can also recommend a local print lab to you; however, Claudia Valcich and Claudia Valcich Photography are not responsible for the quality of prints made by outside labs.
